Terms of Service

Welcome to Pipit. These Terms of Service ("Terms") govern your access to and use of the Pipit mobile application, website, and services (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use Pipit. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activity under your account

3. Marketplace Rules

Pipit is a platform that connects local parents to buy and sell children's gear. When using the marketplace, you agree to:

• List only items you own and have the right to sell
• Provide accurate descriptions and photos of items
• Honor agreed-upon prices and pickup arrangements
• Communicate respectfully with other users
• Complete transactions in good faith

4. Prohibited Items

The following items may not be listed on Pipit:

• Items subject to active CPSC recalls
• Car seats manufactured before 2015 or past their expiration date
• Cribs manufactured before June 2011
• Drop-side cribs of any age
• Counterfeit or stolen goods
• Items that are illegal to sell in your jurisdiction
• Non-children's items unrelated to parenting

5. Fees and Payments

Pipit charges the following fees for completed transactions:

• Seller Fee: 5% of the sale price
• Processing Fee: $0.50 per transaction (covers payment processing)

All payments are processed securely through Stripe. Funds are held in escrow until the buyer confirms pickup, then released to the seller within 24 hours.

6. Escrow and Pickup

Pipit uses an escrow system to protect both buyers and sellers:

• Payment is held securely until pickup is confirmed
• Buyers must confirm pickup within 48 hours of the scheduled time
• If no confirmation is received, funds are automatically released to the seller after 48 hours
• Disputes must be filed within 24 hours of the scheduled pickup time

7. Disputes

If an issue arises with a transaction:

• Contact the other party through Pipit messaging first
• If unresolved, file a dispute within 24 hours of scheduled pickup
• Pipit will review disputes but is not responsible for resolving them
• Unresolved disputes may be directed to Stripe's dispute process

8. Account Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Harass, abuse, or harm other users
• Post false, misleading, or fraudulent content
• Circumvent fees by completing transactions outside the platform
• Create multiple accounts to evade restrictions
• Scrape, crawl, or collect data from the Service

9. Safety Information

Pipit may provide informational recall alerts based on CPSC data. These alerts are provided for informational purposes only and do not guarantee that an item is safe or recall-free. Users are responsible for verifying the safety and condition of items before purchase.

10. Limitation of Liability

Pipit is a platform that connects buyers and sellers. We are not a party to transactions between users. To the maximum extent permitted by law:

• We do not guarantee the quality, safety, or legality of items listed
• We are not responsible for the conduct of any user
• We are not liable for any damages arising from your use of the Service
• Our total liability shall not exceed the fees you paid to Pipit in the past 12 months

11. Indemnification

You agree to indemnify and hold harmless Pipit and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through the app settings.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Spokane County, Washington.
